Letter of Eviction

A letter of eviction is used to evict a tenant from a property, usually an apartment or a house. It could be for not paying the rent, or for violating the contract they signed when they got the lease. For example, if someone leased a house, didn’t pay the rent, and had loud parties every night, the landlord would send them a 30 day letter of eviction. This document means that if they have not vacated the premises in 30 days, the landlord plans to take legal action against them.


Starting to Write


Clearly state the terms of the eviction, such as the number of days until the tenant must leave the property.


Explain the reasons for the eviction and detail your previous attempts to remedy the situation.


If the tenant has deserted the property and left behind belongings, make note that you are not obligated to hold on to it for them.


Sign the letter to legally bind the proceedings.

You are hereby given an eviction notice and notice to vacate the premises on or before November 30th, 2009, the premise owned by Sacramento Properties Inc. in the city of Sacramento, California.


The reason for this eviction notice is:

(X) Your failure to pay rent due in arrears. A demand for payment was made on November 1st, 2009, and you have refused to forward the necessary funds to pay for the rent during this period.


You are hereby notified that if you make all outstanding payments before the date of eviction, you will be able to remain in the premises as long as you continue to pay your rent.

Letter of Eviction to Tenant Sample

Dear Mrs. Kauffman,

I am writing to notify you that you have breached your rental agreement and are therefore evicted from the property. You must gather your belongings and leave the building no later than March 07, 2013.


I have no other choice but to terminate your residency due to the following violations:


a) Destruction of Property: Without permission you hired workmen to knock out the separating wall between the two bedrooms.


b) Unauthorized Renovations: Without permission you attempted to install a conservatory at the rear of the building. After correspondence I permitted you to continue work, but after 5 months this has yet to be completed.


We have had multiple conversations about these matters and you have failed to respect my property or position as landlord.


If you do not vacate the property by the aforementioned date, I will be forced to take legal action.

Letter of Eviction to Roommate Sample

Dear Gabriel,

It pains me to have to do this to a member of the family but you have not respected my wishes and continue to break the rules of the living arrangements offered to you. I hereby serve notice of eviction. You must leave my property within 30 days, else legal action will be taken.


During your time as roommate you have consistently disturbed me and the neighborhood by partying late and welcoming uninvited guests in to the property. You refuse to pay your way, and have even damaged my belongings (see: photo of broken coffee table).


As you are not a legal tenant nor pay rent, there is no lease agreement, and as such you are a guest who has now been uninvited. In effect you are trespassing on my property and I am well within my rights to notify law enforcement.


I hope it doesn’t have to come to that and you will find somewhere else to live within the 30 days mentioned.
